A ROSEDALE man facing a murder charge following the death of a man in February appeared in Sale Magistrates’ Court on Wednesday via video link.
It is alleged 37-year-old Darien McMillan assaulted the man in Rosedale in February, causing his death.
A packed court room heard the names of the witnesses who will be called, including the first police officers on the scene and one witness who claims to have seen the tail end of an assault.
It is expected that video footage of McMillan’s arrest and interview will be used in the trial.
On February 28, investigators were told a man was seen assaulting another Rosedale man on Hood St, near the Princes Highway, just before 10pm.
A 43-year-old man was found by police lying on the road.
He was flown to Melbourne with serious head injuries, but died on March 1.
Homicide Squad detectives arrested McMillan, who was then interviewed at Sale police station at 4am, in a “highly agitated state”.
It was alleged both men were heavily intoxicated, and were known to each other.
McMillan was told he will appear again via video link for a special mention on October 4.
